These terms and conditions apply to the Dank Blossom Grow Journal app (the "Application") for mobile and web devices, created by Dank Blossom Inc. (the "Service Provider") as a free and subscription-based service. Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.
1. Acceptable Use
By using the Application, you agree to use it only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the service. You agree that you will not:
- • Use the Application to store, share, or promote any unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content.
- • Attempt to gain unauthorized access to the Application's systems, user accounts, or data.
- • Use the Application to send unsolicited communications, spam, or advertising.
- • Interfere with or disrupt the service, servers, or networks connected to the Application.
- • Use the community features to harass, abuse, or impersonate other users.
- • Reverse engineer, decompile, or attempt to extract the source code of the Application.
The Service Provider reserves the right to suspend or terminate access for any user who violates these terms.
2. Intellectual Property Rights
The Application, including its design, content, features, and functionality, is the exclusive property of Dank Blossom Inc. and is protected by international copyright, trademark, and other intellectual property laws. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited.
Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
Content you create in the Application — such as plant profiles, logs, photos, and community messages — remains your property. By posting content in community features, you grant the Service Provider a non-exclusive, royalty-free license to display that content within the Application.
3. Service Modifications & Charges
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, we reserve the right to modify the Application or charge for our services at any time and for any reason. Any charges for the Application or its services will be clearly communicated to you. Subscription plans include a Free tier (no charge), a Basic tier ($4.99/month or $49.99/year), and a Premium tier ($9.99/month or $99.99/year). All subscription payments are non-refundable and automatically renew at the end of each billing cycle unless canceled.
4. Third-Party Services
The Application utilizes third-party services that have their own Terms and Conditions, including:
- • Google Play Services
- • Payment processors (Base44 Payments / Wix Payments) for subscription billing.
- • Social media platforms (Facebook, Instagram, LinkedIn) for optional content sharing.
The Service Provider does not assume responsibility for the practices or content of these third-party services.
5. Limitation of Liability
The Service Provider does not assume responsibility for certain aspects of the Application's performance. Please be aware of the following:
- • Some functions of the Application require an active internet connection (Wi-Fi or mobile data). The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of connectivity or exhausted data allowances.
- • You may incur charges from your mobile network provider for data usage during connection to the application, including roaming data charges. By using the application, you accept responsibility for any such charges.
- • The Service Provider cannot always assume responsibility for your usage of the application. It is your responsibility to ensure your device remains charged and functional.
- • The Application relies on third parties to provide certain information (such as weather data and AI analysis). The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality.
- • AI-generated health checks, insights, and recommendations are suggestions only and may not be 100% accurate. Always use your own judgment and consult professional resources before making decisions about your plants.
- • The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
6. Device & Account Security
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.
7. Updates & Termination
The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems we decide to extend the availability of the application to), which may change. You will need to download updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered.
The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice. Upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application and, if necessary, delete it from your device.
8. Changes to These Terms
The Service Provider may periodically update these Terms and Conditions. You are advised to review this page regularly for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. Your continued use of the Application after changes constitutes acceptance of the updated terms.
